TO THE MAXIMUM EXTENT PERMITTED BY LAW, OCTAGEEKS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR LOSS OF GOODWILL.
IN NO EVENT SHALL OCTAGEEKS’ TOTAL LIABILITY EXCEED THE AMOUNT PAID BY THE CUSTOMER TO OCTAGEEKS DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
You agree to defend, indemnify, and hold harmless OctaGeeks, its owners, employees, contractors, affiliates, and licensors from any claims, damages, liabilities, costs, and expenses arising from:

Any legal action arising under these Terms shall be brought in the appropriate state or federal courts located in North Carolina.
If any provision of these Terms is determined to be unenforceable, the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy and any written service agreement between you and OctaGeeks, constitute the entire agreement regarding your use of the Services.
